JumpOnIt.com (the "Site") is an interactive online service operated by Jump On It Pty Limited [ACN: 141 684 684 of Level 11, 37 Pitt Street, Sydney 2000] ("Jump On It"), consisting of information services, content and transaction capabilities provided by Jump On It, affiliates of Jump On It and other third parties.
By using the Site, you are deemed to have read, understood and agreed to be bound by these Terms of Service and our Privacy Policy (which is incorporated herein by reference) (summarily, "the Terms").
a) By using the Site, you agree to be bound by the Terms. If you do not agree to the Terms, please refrain from using the Site.
b) Jump On It reserves the right to make any changes to the Terms as it deems necessary or desirable without prior notification to you. We suggest to you, therefore, that you re-read the Terms from time to time in order that you stay informed as to any such changes.
c) If we make changes to the Terms you continue to use the Site, you will be deemed to have read, understood and agreed to be bound by the updated Terms.
d) Any provision of the Terms which is held to be illegal, void or unenforceable shall be deemed to be severed and the remainder of the Terms read in full force and effect.
e) Jump On It's failure to enforce any provision of the Terms will not be considered a waiver of its right to enforce such provision.
f) The Terms are to be interpreted in accordance with the laws of New South Wales. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, and waive any right to claim that those courts are an inconvenient forum.
a) You shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Site and all charges related thereto.
b) Jump On It shall not be liable for any damages to the your equipment resulting from the use of the Site.
a) The Site and any individual sites or merchant-specific, city-specific, or state-specific sites now or hereinafter contained within or otherwise available through external hyperlinks within the Site (the "Microsites") are private property. All interactions on the Site and/or the Microsites must comply with the Terms.
b) Although Jump On It welcomes and encourage user interaction on the Site, we insist and require that you restrict any and all activity in connection with the use of the Site and the Microsites to that which involves lawful purposes only.
c) You must not post or transmit through the Site any material which violates or infringes in any way upon the rights of others, or any material which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law.
d) You shall not use the Site or any of the Microsites to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of users of the Site and/or the Microsites to become users of other on- or offline services directly or indirectly competitive or potentially competitive with Jump On It.
a) Everything located on or in the Site, including the Microsites, is the exclusive property of Jump On It Pty Limited or used with express permission of the copyright and/or trademark owner.
b) Any copying, distributing, transmitting, posting, linking, deep linking, or otherwise modifying of the Site or any of the Microsites without the express written permission of Jump On It Pty Limited is strictly prohibited.
c) Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and / or criminal penalties. You may download, print and/or save copyrighted material for your personal use only.
a) Jump On It, similar to an Internet Service Provider, is a distributor (and not a publisher) of content supplied by third parties and End Users. Accordingly, Jump On It has no more editorial control over such content than does a public library, bookstore or newsstand.
b) Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, are those of the respective author(s) or distributor(s) and not necessarily of Jump On It.
c) Jump On It cannot guarantee the accuracy, completeness, or usefulness of any content expressed or made available by third parties, nor its merchantability or fitness for any particular purpose.
d) It is your responsibility to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, etc., or other content available through the Site.
e) Jump On It contains links to third party websites maintained by other content providers. These links are provided solely as a convenience to you and not as an endorsement by Jump On It of the contents on such third-party sites and Jump On It hereby expressly disclaims any representations regarding the content or accuracy of materials on such third-party websites.
f) If you decide to access linked third-party website, you do so at your own risk.
a) Subject to claims available under applicable consumer protection laws, neither Jump On It nor its related bodies corporate is liable:
(i) to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including any form of consequential loss such as any third party loss, loss of profits, loss of revenue, loss of opportunity, loss of anticipated savings, pure economic loss and any increased operating cost) however caused and which is suffered directly or indirectly in connection with your use of the Site;
(ii) for disruptions to the Site; and
(iii) to you or anyone else if interference with or damage to your computer systems occurs in connection with use of this Website or an external website. You must take your own precautions to ensure that whatever you select for use from this Website is free of viruses or anything else that may interfere with or damage the operation of your computer systems.
b) For claims that cannot be excluded or restricted under consumer protection laws , the liability of Jump On It for such a claim will (to the extent permitted by law) be limited to:
(i) in the case of goods:
(A) repairing or replacing those goods; or
(B) paying the cost of having those goods repaired or replaced; and
(ii) if the breach relates to services:
(A) resupplying those or equivalent services; or
(B) paying the cost of having those services resupplied.
c) Jump On It will not be liable for any delay in fulfilling its material obligations under the Terms if such delay is due to an act of God, act of terrorism, revolution, civil strife, industrial action, fire, flood, war, public disaster, plague or epidemic, delay in transportation or other cause, event or circumstance outside Jump On It's control which is not due to any lack of reasonable prudence or foresight.
a) You will at all times indemnify, and keep indemnified, Jump On It and its directors, officers, employees, agents and related bodies corporate from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by Jump On It arising from any claim, demand, suit, action or proceeding by any person against you or Jump On It where such loss or liability arose out of, in connection with or in respect of your use of the Site, your conduct and/or your breach of the terms.
a) In order to have access to all operative parts of the Site, and to purchase vouchers via the Site, you must first create an account on the Site. When creating an account, you will be asked to provide an email address and your geographic location.
b) By creating an account, you consent to Jump On It sending you information and email communications relating to daily deals, special offers and important administrative information regarding the Site.
c) Jump On It reserves the right to refuse registration of an account (or to close an existing account) where:
(i) you have opened, or are attempting to open, an account in a fraudulent or illegal manner;
(ii) you have an existing account;
(iii) It is compelled to do so by any applicable law or court order; or
(iv) you have breached the Terms;
d) You are solely responsible for the activity that occurs on your account and for keeping your account details secure and up to date.
a) By making an order to purchase a Deal, you warrant to Jump On It that you are:
(i) eighteen (18) years of age or above; and
(ii) entering into a legally binding contract with Jump On It with respect to that Voucher.
a) Jump On It provides account-holders with opportunities to purchase Vouchers which can be redeemed with third party merchants (each, a 'Merchant') for goods and services at discounted rates and on certain terms and conditions of the Merchant (each, a 'Deal').
b) By making an order to purchase a Voucher on the Site, you agree to receive and be charged for the Voucher once Jump On It has received a specified minimum quantity of offers to purchase a Voucher from Jump On It account-holders during a specified selling period.
c) By placing an order for a Voucher on the Site, you are making an offer and commitment to purchase a Voucher on the Terms, and on the specific terms outlined in the 'Conditions' section of the page on which the Deal is published.
d) Jump On It reserves the right to accept or reject your offer to purchase a Voucher for any reason. In the event Jump On It cancels your order to purchase a Voucher, Jump On It will charge-back the full purchase price to your credit card.
e) Once you have made an order to purchase a Voucher on the Website, you cannot cancel that order.
a) Once you have placed your order for a Voucher, you will be prompted to enter your credit card information for payment purposes.
b) Once you have entered and confirmed your credit card details, you will have bought your Voucher. You will then receive a confirmation of your order (whether by email or via your Account) and your credit card will be charged for the purchase price of the Voucher.
c) You will only be issued a Voucher if full payment for that Voucher has been received by Jump On it; and the specified minimum quantity of offers has been reached.
d) A Voucher may take the form of a physical voucher, a unique code, a hyperlink or an electronic voucher and may be delivered to you via email, by post or may be downloadable on the Site.
e) Jump On It is not liable or responsible for any loss suffered as a result of a Voucher not being received by you (including, without limitation, due to an email being blocked by a firewall or filter or where you have registered an incorrect email address).
a) If you make an order to purchase a Voucher, and the specified minimum quantity of offers is not reached, Jump On It will charge-back the full purchase price to your credit card.
b) You will not be to entitled to any refund on the purchase price of an issued Voucher, except as required by law. However, Jump On It will provide a no-questions-asked money-back guarantee and refund the full purchase price of any Voucher, for any reason, within 5 days of purchase.
c) If for any reason you cannot redeem a Voucher (including but not limited to circumstances in which a Merchant goes out of business or ceases offering the service described in the Deal), Jump On It will provide a full refund if you request such a refund during the Voucher validity period.
The following are examples of our refund policy in action:
a) The Merchant goes into liquidation
If you believe that a Merchant has gone into liquidation, simply let us know and we'll look into it. If we find that the Merchant has gone into liquidation and that you have not redeemed your Voucher, we guarantee to provide your choice of a full refund or equivalent Deal Bucks.
b) The Merchant fails to provide the goods or services
If a Merchant fails to provide the goods or services listed on your Voucher, simply let us know and we'll look into it. If we find that the Merchant has failed to provide the goods or services listed on your Voucher and that the Merchant has no reasonable grounds for its failure, we guarantee to provide your choice of a full refund or equivalent Deal Bucks.
c) The goods or services provided by the Merchant are not as advertised
If a Merchant fails to provide the goods or services as advertised by us, simply let us know and we'll look into it. If we find that the Merchant has failed to provide the goods or services as advertised, that the Merchant has no reasonable grounds for its failure and that you did not accept alternative goods or services in exchange for your Voucher, we guarantee to provide your choice of a full refund or equivalent Deal Bucks.
Please understand that for all of the above scenarios, a refund is only payable if you contact us prior to the expiry of your Voucher or within a reasonable period after the events described.
a) You may redeem a Voucher that Jump On issues to you with the relevant Merchant in order to receive the good or service that is the subject of the associated Deal. The relevant Merchant, not Jump On It, is the provider of the product or service and is solely responsible for honouring the Deal that is the subject of the Voucher you have purchased.
a) Each Voucher you purchase from Jump On It may be subject to specific terms, conditions, rules and/or limitations which will be communicated to you on the Site prior to your purchase of the Voucher. To the extent there is any inconsistency between the terms expressly set out on the Voucher and the Terms, the terms expressly set out on the Voucher will prevail.
b) Unless otherwise stated on the Voucher, the following terms apply to all Vouchers (without limiting the other terms and conditions in these Terms & Conditions of Use):
(i) Vouchers are not redeemable for cash
(ii) Vouchers cannot be used in conjunction with other offers or discount coupons
(iii) ) If, for any reason, you do not or cannot use or redeem a Voucher you have purchased in full, you will not be entitled to any consideration, credit or full or partial refund on the purchase price of that Voucher, except as required by law
c) Jump On It will re-issue Vouchers on request.
d) The expiration date for a Voucher is as printed on the Voucher and will be referred to on the Site. All Vouchers are deemed void after the published expiration date and will not be honoured by Jump On It or the Merchant unless otherwise agreed. Expired Vouchers are non-refundable in whole or in part.
e) Vouchers may not, without the prior written consent of Jump On It, be resold or offered for resale, duplicated, used, traded or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services.
a) All Deals relating to services provided by Merchants are subject to availability and may require you to make a booking in advance directly with the Merchant. Jump On It cannot guarantee that services will be available to you at your preferred date or time.
b) You agree that any booking you make with a Merchant may be subject to that Merchant's separate terms and conditions or policies.
c) If you cancel a service booking you have made directly with a Merchant, the Merchant may charge you a cancellation fee (which may include invalidation or cancellation of your ability to redeem the relevant Voucher).
a) For Deals relating to products provided by Merchants, you may be required to collect the relevant product from a specified location or to pay a fee to have the product delivered to
a) To be eligible for the "Refer-a-friend" $10 Jump On It credit, your referral must meet the following criteria:
(i) Your "friend" must have signed up directly via the link specified in your refer-a-friend email
(ii) Your "friend" must have made a purchase
b) You will not be given $10 credit for a referral in the case that your "friend" has signed up, via any other channel other than directly through the refer-a-friend link specified in the email. You will not receive any credit for subsequent purchases after the first purchase made.
c) Once your referred friend has made a purchase you will receive a $10 credit in your Jump On It account, which you can use towards the purchase of any Deal of your choice.
